Terms of Service

Effective Date: February 20, 2026

Introduction

These Terms of Service ("Terms") govern access to and use of the Complitrac application, websites, and related services (collectively, the "Services") operated by Complitrac Inc. ("Complitrac," "Company," "we," "us," or "our").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to comply with these Terms and all applicable laws and regulations.

2. Account Registration and Responsibilities

You must provide accurate information, maintain confidentiality of credentials, and notify Complitrac of unauthorized use.

3. Team Accounts and Membership

Champions manage roles, access, subscriptions, billing, and cancellations. Role-based access controls are enforced, and you are responsible for the activities of users associated with your account.

4. Permissions and Access Controls

Unauthorized access or misuse of the Services is prohibited.

5. Acceptable Use

The Services may not be used for unlawful or abusive activities. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Data Protection and Information Security

Complitrac implements safeguards designed to protect the confidentiality, integrity, and availability of data within the Services. You are responsible for safeguarding your own account information and credentials.

7. Service Availability

The Services are provided on an availability basis and may undergo maintenance, updates, or modifications from time to time.

8. Subscription, Billing, and Payment

8.1 Subscription Term

Your subscription to Complitrac Services commences on the date you complete onboarding (the "Billing Start Date") and continues on a month-to-month basis until terminated in accordance with these Terms.

8.2 Auto-Renewal

Subscriptions automatically renew for successive one-month periods on the same calendar day of each month as the Billing Start Date unless properly canceled as indicated in Cancellation and Termination, section 9.1.

8.3 Subscription Plan

Complitrac offers a standard subscription plan that includes access to an included monthly Job Limit. Additional details about plan features are described in the Billing tab of your account.

8.4 Changes to Plans or Pricing

We may modify subscription plans, features, Job Limits, Overage Rates, or other aspects of the Services at any time. We will provide reasonable advance notice of material changes via email and/or in-app notification, giving you an opportunity to review the changes and cancel your subscription if you do not agree.

8.5 Subscription Fees

You agree to pay the applicable Subscription Fees for your plan as displayed at the time of signup or renewal and as may be updated from time to time.

8.6 Overage Fees

If you exceed the included monthly Job Limit during any billing period, you may purchase additional Job increments at the then-current overage rate. Overage charges will be billed on your next billing cycle or as part of a final invoice if applicable. Unused included Jobs and purchased additional Jobs do not roll over to future periods.

8.7 Billing and Payment Authorization

All fees are in U.S. dollars and are non-refundable except as expressly provided in these Billing Terms or required by law. You authorize Complitrac (or its payment processor) to charge your designated payment method on the Billing Start Date and each subsequent renewal date for applicable Subscription Fees and any Overage Fees. You are responsible for maintaining accurate payment information. If a charge is declined, we may retry payment and/or suspend access until payment is received.

8.8 Taxes

You are responsible for all applicable taxes associated with your use of the Services, except taxes based on our net income.

9. Cancellation and Termination

9.1 How to Cancel

To cancel your subscription, you must complete and submit the official Cancellation Form available in the Billing tab of your Complitrac account. No other cancellation method (including email, support ticket, or phone) will be accepted.

9.2 Cancellation Timing and Effect

  • (a) If you submit a valid cancellation request at least twenty-one (21) days before your next renewal date, your subscription will terminate at the end of your then-current paid billing period and no further automatic renewals or charges will occur, except for any final Overage Fees.
  • (b) If you submit a cancellation request fewer than twenty-one (21) days before your next renewal date, your subscription will renew for the upcoming month, you will be charged the applicable Subscription Fees for that period, and your account will terminate at the end of that renewed period.

9.3 Account Closure and Final Billing

Upon termination, account access will be closed. Any Overage Fees incurred during your final billing period may be charged on or shortly after the end of that period and may appear as a final invoice in the following month.

9.4 Suspension and Termination by Complitrac

Access may be suspended or terminated for violations of these Terms, non-payment, or security concerns.

10. Fees and Refunds

Except as required by applicable law, we do not provide refunds or credits for partial months, unused Jobs, early termination, or downgrades for any products, services, or subscriptions once a transaction has been completed. Customers are responsible for reviewing all applicable product descriptions, service details, and subscription, billing, and cancellation terms prior to completing a purchase. By submitting payment, you acknowledge and agree that the purchase is final, and that no refunds will be issued.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of updated Terms. You will be notified in the event of a material change to our Terms of Service.

12. Governing Law

These Terms are governed by the laws of the State of Texas.
